Truck Driver Allegedly Fails To Merge Killing Road Worker — Could Face Charges

Indiana authorities are considering filing charges against a truck driver after investigators say the driver failed to merge safely in a construction zone striking a construction vehicle which then struck and killed a road worker.

The Hamilton County Sheriff’s Office responded to a report of a pedestrian struck on US 31 just south of 296th Street around 12:40 p.m. on Wednesday. Investigators believe a 43-year-old man was driving a red 2012 Kenworth semi northbound on  US 31 in the right lane and did not see the construction vehicles with arrow boards activated that were directing traffic to merge into the left lane.

The truck driver was unable to stop in time while merging and rear-ended a construction vehicle with the arrow board attached. The construction vehicle then struck a construction worker causing fatal injuries. Justin Nance, 32, was pronounced dead at the scene.
